Manual in Terms of Section 51 of the Promotion of Access to Information Act, 2 of 2000

1. Introduction

This manual is published in terms of Section 51 of the Promotion of Access to Information Act, No 2 of 2000 ("PAIA") and in terms of Regulation 4(1)(c) of the Protection of Personal Information Act, No 4 of 2013 ("POPIA").

The purpose of PAIA is to give effect to the constitutional right of access to any information held by the State and any information that is held by another person and that is required for the exercise or protection of any rights.

4. Guide on How to Use PAIA

The South African Human Rights Commission ("SAHRC") has compiled a guide containing information to assist a person wishing to exercise a right of access to information in terms of PAIA and POPIA.

6. Records Available on Request

7. Request Procedure

A request for access to information must be made on the prescribed form (Form C) obtainable from the SAHRC website. The form must be submitted to the Information Officer at the address provided above.

A request fee and access fee may be payable in accordance with the fees prescribed by the Minister of Justice.

8. Grounds for Refusal

Access to records may be refused on the grounds set out in Chapter 4 of PAIA, including but not limited to:

  • Protection of personal information of third parties
  • Protection of commercial information of third parties
  • Protection of confidential information of third parties
  • Legal professional privilege
  • Records privileged from production in legal proceedings
